GMI in the Constitutional Court - De Klerk v Minister of Police
Johannesburg, 15 November 2018 – a man from Gauteng claims about R330-thousand from the police after he was arrested in 2012 and held in custody for 8 days. The police conceded that they did not have a warrant for Bryan de Klerk’s detention, who was arrested on a charge of assault with intent to do grievous bodily harm.
According to the Supreme Court of Appeal judgment, the police are only liable for the two hours De Klerk spent in custody. De Klerk is asking the Constitutional Court to order the Minister of Police to compensate him for the whole time he was in custody.
